| 摘 要： | 《中华人民共和国物权法》关于不动产登记错误损害赔偿问题只进行了原则性规定，对登记错误如何认定，受害人如何获得司法救济，相关法律、法规及司法解释没有明确界定。应从不动产登记行为的性质着手，探讨对不动产登记错误归责原则、登记机关承担赔偿责任的构成要件、受害人获得司法救济及完善登记错误损害赔偿途径等。
