| 摘 要： | 分时度假作为新兴的集房地产、旅游、融资为一体的新型生活消费模式，自20世纪在欧美发达国家时兴起来后，深受广大消费者的欢迎。分时度假在上世纪90年代逐渐登陆中国这片广大的市场，然而由于我国法律制度的缺失、人们文化观念的落后、诚信意识的贫乏，导致分时度假成为“诈骗”的代名词，广大消费者深受损害。从分时度假合同作为切入点，分析了利用合同侵害消费者合法权益的现象，并提出规制分时度假合同的建议措施，以探寻保护消费者合法权益、促进分时度假发展的途径。

| Abstract: | Timeshare vacation as a new set of real estate, tourism, and financing tora new life consumption pattern since twentieth century in Europe and the United States after the Renaissance, has been deeply welcomed by general consumers. Timeshare vacation in the 1990＇s in China gradually the gained vast market. However, due to the lack of the legal system, people＇s traditional culture the good faith consciousness, timesbare vacation becomes the pronoun of ＂fraud＂. This article, from the timeshare vacation contract as a starting point, analyzes the use of contract infringe upon the lawful rights and interests of consumers phenomenon, puts forward the regulation timeshare vacation contract proposal for measures to protect consumers＇ legal rights and interests, and promotes the development of timeshare vacation way. |
