| 摘 要： | 信托制度是英美法最伟大最杰出的成就,研究英美法信托制度的优秀成果,对于发展和完善我国刚刚起步的信托制度具有重要意义。从现实生活中的真实案例说起,指出了在我国现有的法律制度框架内处理该问题的困难,并通过探讨英美法推定的归复信托,寻找解决该问题的途径,试图为我国更好地移植英美法优秀的发展成果提供思路。

Brief Analysis of Presumed Resulting Trusts in the Country of Britain, USA and France Common Law |

| Abstract: | The trusts was the greatest achievement of common law. It is benefit for us to studying it. This article mentioned from a real case, had pointed out that there are difficulties to solve the problem in our recent legal system, and through discussed the presumed resulting trusts, sought to find the solution. Attempts to provide the mentality well of transplant the trust to our country. |
