| 摘 要： | 法律与道德两者属于上层建筑 ,具有同质性 ,因而法律的道德化得以可能 ;但是由于两者又具有异质的一面 ,故法律道德化又存在限度。实行合理的法律道德化有利于我国“依法治国”、“以德治国”这一治国方略的真正实现。

| Abstract: | Law and morality, subordinate to the upper structure, have joint quality ,so it is likely to moralize to law. .But they two have non-quality side .As a result ,moralization to law has its own limits .Consequently it suggests in the article that to reasonably make morality legalization is benefitial to realize general plan for administering a country with "administration with law","administration with morality"in practice. |
