| 摘 要： | 亲属容隐是中国古代的一项重要法律制度,有学者以睡虎地秦墓竹简中“子告父母,臣妾告主,非公室告,勿听”的规定为证,认为“亲亲相隐”的制度起源于秦律,这是对“告”和“听”意思的误解,在理论上混淆了亲属间的法律关系与国家和家庭间的法律关系。现有材料只能证明亲属容隐制度最早出于汉宣帝地节四年。

| Abstract: | The permition of the relatives shelter and conceal each other is an important law system of the Chinese ancient times,having some scholars think that the system is from the Law of Qin dynasty by what were written on the sleep tiger last home bamboo that the son accused the parents,the slave accused the lord,not the Litigation have relationship with state,I think the system come from the forth year in in Dijie in Qanyuandi's period at the earliest stage.why they think so is with the misunderstanding of the" accuse" and " hear" meaning.they confused the relatives between a law of law relating and a law of nation to family theoretically. |
