| 摘 要： | 本文探讨了P2P技术下版权人与P2P软件用户以及软件服务提供商的利益冲突以及P2P技术对传统版权法律规则提出的挑战。建议我国应尽快完善规制P2P技术的数字版权立法，并对此提出两点建议：版权法利益均衡原则的破与立，以及建立数字版权综合管理体系。

| Abstract: | This paper introduces the conflicts of interest under P2P technology between the copyright holders and P2P providers, even P2P users, as well as the challenges towards traditional low of copyright, and suggests that China perfect digital copyright legislation to regulate P2P technology, then makes two recommendations, that is, breaking and establishing the principle of balance of interests of copyrights of low, and establishing integrated digital rights management system. |
