| 摘 要： | 在原视频文件中添加网站标识构成对原视频文件的改变，而采用非纯技术手段进行编排不构成对原视频文件的改变，仅仅导致视频网站注意义务的增加。对原创与非原创栏目的区分不能表明视频网站知道或者应当知道网络用户上传的涉案作品侵犯了他人的著作权。视频网站在播放网络视频的同时显示广告不构成从中直接获益。《互联网视听节目服务管理规定》宣告了我国视频网站在避风港全体搁浅，这种一刀切的方式使得ISP与ICP的区分再无意义，《信息网络传播权保护条例》几乎成为一纸空文。

| Abstract: | Adding site logo in the original video files is considered as a change of the former video files, while non - pure technical arrangement doesnt change the former video files , only leads to an increase of the duty of care. The distinction of original and non - original videos doesn＇t mean that the video sharing sites know or should know the tort of the copyright. Displaying advertisements while playing online video should not be considered as a direct benefit from the online video. Internet Audio - visual Program Service Management Requirements have declared that all Chinese video - sharing sites ran aground in safe harbor, which makes the distinction between ISP and ICP meaningless. Meanwhile ,Regulations on Protecting the Information Transmission Right in Network almost becomes faded word on parchment. |
