| 摘 要： | 我国刑法分则中分别有条文将以营利为目的和牟利为目的规定为犯罪的构成要件,文章认为两者的刑法含义上并无本质不同,立法上宜统一规定为以牟利为目的,并对以牟利为目的的司法认定略作探讨.
