| 摘 要： | “为他人谋取利益”是受贿罪得以成立的构成要件之一。该文分析了“为他人谋取利益”作为受贿罪构成之要件的诸多弊端,即造成刑法理论上的冲突,带来立法与司法上的困惑。从而得出结论,不应以其为受贿罪的构成要件,而应作为一个量刑情节。

| Abstract: | To seek benefit for briber" is one of elements of the crime of taking.This thesis analyzes the bad aspects of seeking benefit for briber as an element of the crime of taking bribes, that is, causing conflicts in theories of criminal law , and bringing confusions in legislation and judicature.Therefore, to seek benefit for briber can not be an element of the crime of taking bribes, but should only be regarded as a measurement for the guilt. |
