| 摘 要： | 学位授予程序作为学位授予制度的核心内容,决定着学位授予的质量和公信力。近年来,高校未遵循学位授予的正当程序而在学位纠纷案件中败诉的新闻屡屡成为舆论的焦点。随着“依法治教”“依法治校”工作的开展,正当程序原则在学位授予制度中的地位愈加凸显。通过回顾与总结有关正当程序原则的学位纠纷案件及其特征,从中窥见正当程序原则在我国学位授予制度中的适用现状与存在的问题,进一步探讨正当程序原则在学位授予制度中的适用。

| Abstract: | As the core content of the degree-granting system,the degree-granting procedure determines the quality and credibility of the degree-granting.In recent years,the news that colleges and universities failed to follow the due process of degree-granting and lost lawsuits of degree disputes has repeatedly become the focus of public attention.With the development of“administering education by law”and“administering schools by law”,the principle of due process is becoming more and more important in the degree-granting system.By reviewing and summarizing the degree dispute cases related to the principle of due process and their characteristics,this articles sums up and analyzes the current situation and problems of the application of the principle of due process in the degree-granting system in China,and further explores the application of the principle of due process in the degree-granting system. |
