| 摘 要： | 正确把握商法的基本特征是科学确定商法基本原则的前提。基于效率与安全的价值理念，商法中融入了越来越多具有公法性质的规范，法定强制性已经成为商法的内在特征。探究商法中法定强制性存在的理论依据，分析其在商法基本原则中的具体体现，认真对待商法的这种特征，有助于商法基本原则的科学化和理性化。商法在构筑自己特有的基本原则时，必须体现出其所蕴含的不同于民法的法定强制性。
