| 摘 要： | 作为世界五大法系之中的中华法系和大陆法系，分别代表了古代东西方法律文化的最高成就。东西方不同的社会条件孕育了不同的法律制度，其中的法律思想也不同。造成它们法律思想差异的因素很多，本文试从自然条件及生产方式、国家管理体制、文化三个方面阐述对法律思想的影响。

| Abstract: | Being one of the world five fundamental legal families, Sino-legal family and Continental legal family each presented the highest achievement of eastern and western legal cultures. Different society condition has been fraught with different legal system in the east and west, law thoughts among them haven＇t been same. Many factors make their law thoughts different. This essay tries to explain the effects on law thoughts via three factors, which are natural conditions, mode of production, country management system, and culture. |
