| 摘 要： | "人"是法学研究的基本范畴之一,传统的中国法律在价值取向上重权力、轻权利;重国家利益、社会利益、轻个人利益,造成现实的中国法制重"物"不重"人",事实上,不仅仅文学艺术在塑造着人,法律也以其特殊的方式塑造与培养着人。法的历史就是不断对"人"的设计、塑造与培育的历史。法学关于人的主要课题可分成宏观和微观两个方面。法律人是法学的研究切片与假设,法律人具有其独特魅力与价值,也有其缺陷需要弥补。从现实的人到现代化的人到全面而自由发展的人,反映了从当前到未来社会的一段漫长的过程,与此相应,法学研究目标按其实现程度可分为现实目标和终结目标。

| Abstract: | Humans" are one of the basic categories of law study. The trend of value about traditional Chinese law laid stress on power, but made light of right; it attached great importance to national and social benefit, and made light of individual benefit, which results in the fact that Chinese law lays stress on "object", not on "humans". In fact, it is not only literature and art that help one mold one's character; also law creates and brings up humans in special ways. The history of law is just one in which "humans" are designed, molded and raised constantly. The main subject about humans of the science of law can be divided into two aspects: macroscopic and microscopic. Legal person, the section and hypothesis in the science of law, possesses unique charm and value, meanwhile he has faults which need to be put right. The whole process from realistic "person" to modern "person" to the all-round and freely developing "person" reflects a long course from now to future. And the goal of law research can be divided into realistic aim and ultimate aim according to the level of realization. |
