| 摘 要： | 鉴定意见是我国诉讼法中证据种类的一种，对案件事实的认定具有重要的作用。由于鉴定意见具有较强的专业性，不同于其他证据可以由法官凭借法理与经验判断，需要借助于专业知识的判断；且正是由于它的专业性带来的权威性导致其对于案件的审判具备超乎其他证据更强的证明力，所以法院应该更加注重对鉴定意见的审查。法院在决定是否采纳鉴定意见时，可以从证明能力和证明力两方面进行考察，通过专家证人出庭、鉴定意见质讧等方式以确保鉴定意见的合法性，从而有效合法地适用鉴定意见证据，最终保障当事人的诉讼权利。

| Abstract: | Authentication expertise is one kind of evidence in the procedure law of our country, plays an important role in the cognizance of the case facts. It is very professional and then relies on professional knowledge judgment. So it is different from other evidences which can be judged by a judge with legal theory and experienced judgment. And it has stronger probative force in the trial because of its authority brought by the professionalism, so the court should pay more attention to the review of the authentication expertise. When deciding whether to adopt authentication expertise or not, the court can think from its proof ability and certification. By cross - examination between appraiser and expert witness, the judge can ensure the validity of the authentication expertise, thus legally apply it and eventually protect the litigation fights of the parties. |
