| 摘 要： | 合同的订立过程都包含要约和承诺两个步骤，一般地说合同的成立是双方当事人协商一致合意的结果。而电信合同采取格式条款的交易形式，虽有要约和承诺步骤，但却没有协商的过程，也就是没有反要约的环节。由于电信行业的经营垄断性和电信合同的条款格式化使电信合同的成立具有其特殊性。因此，电信经营者的合理提示合同条款是合同成立的先决条件，电信消费者的明示同意为合同成立的必要要件。

| Abstract: | The process of establishing a contract consists of two steps: agreement and commitment.Generally speaking,the establishment of a contract is the consultation result of the both parties.And the telecommunication contract adopts the bargain form of the format item.Although it also includes agreement and commitment,it includes no process of consultation,that is,the consumer has no chance to write his requirements into the contract.Because the management monopolization of the telecommunication profession and the telecommunication contract item formation makes the establishment of the telecommunication contracts have its special characteristics.Therefore,the reasonable hint on the contract item of the telecommunication executive is precondition to the establishment of the contract,and the clear exprevsion of the telecommunication consumer's agreement is the necessary condition for the contract establishment. |
