| 摘 要： | 对法官认证时行使自由裁量权的制约，应该有一个比较完备、合理的机制。该机制包括对法官素质和立场的要求、自由裁量必须符合一定条件、加强对认证时自由裁量的有效监督、建立一套完善的证据规则。

| Abstract: | In the civil litigation, justice must have the free judging power, but at the same time the perfect restrictive system must be set up. The restrictive system includes four aspects: the demand for justice, capitulation, perfect supervision to the authentication, and evidence regulations. |
