软法与高校人力资源管理

摘    要:软法是伴随着公域治理模式的转型而出现的一种思潮和规范现象。在事业单位改革和高校去行政化的背景下,运用软法的精神和机制能够消解高校人力资源管理的行政化倾向,塑造其民主自治品格。在制度建设方面,软法应该协调国家法,成为高校人力资源制度制定和实施过程中的导控性装置。

Abstract:As one kind of ideological trend and the rule phenomenon,soft law appears the following public domain government pattern reforming.In institution reform and elimination university administration’s characteristic background,the character and the mechanism of soft law can be utilized to dispel the administration tendency of university human resources management to mold its democracy autonomous character.In system development,soft law should coordinate with the state law and become the leading and controlling device in the university human resources system formulation and implementation process.
