| 摘 要： | 欧洲法治进程是与欧洲的人文主义和个性解放紧密相连的,但是对"人本"思想的狭隘理解和对"自由、民主与人权"的激进主张必然会阻碍欧盟法治进程和引发欧美法治瑕疵,促使人们不断反思并形成一股强劲的社会思潮,真正意识到马克思主义的正确性并最终重拾马克思主义.欧洲法治只有坚持马克思主义范畴中的"人本"思想,才能更有力地维护良好社会秩序,造福予人类.

| Abstract: | Although the process for Europe ruled by law is closely related to European humanism and liberation of individuality,a narrow understanding of "human-oriented thought"and radical views on "liberty,democracy and human rights" undoubtedly hinders this process and brings about its flaws such as the abortion of Treaty Establishing a Constitution for Europe and recent financial crisis in Europe and the U.S.,and what not,which prompt people to reflect and form a strong ideological trend or enlightenment campaign ... |
