| 摘 要： | 竞技体育伤害是体育比赛中的常见现象,刑法可否介入体育比赛伤害行为的规制以及如何规制,成为体育法学界关注的重要问题之一。在借鉴现有研究成果的基础上,对竞技体育伤害的内涵进行了重新界定,认为除了伤害后果外,伤害发生的体育运动的类别、伤害行为发生的时间和空间、伤害行为的主体与对象等也是影响刑事责任认定的重要因素。提出,刑法对竞技体育伤害行为的规制应当坚持有利于体育事业发展的原则,参照运动项目的伤害风险,重视当事人的选择权,考察行为人的主观恶性。

| Abstract: | The competitive sports injury is a common phenomenon in sports. Whether the criminal law regulation can step in sports damage behavior and how to regulate become one of the important problems of sports law. On the basis of existing re- search results, to redefine the connotation of the competitive sports injuries, this paper thinks that in addition to the injury con- sequences, the types of sports injuries and damage behavior＇s time and space, the damage behavior＇s subject and object are the im- portant factors that affect criminal responsibility identification. It puts forward that for competitive sports injury behavior of the criminal law regulation shall adhere to the principle of benefiting to the development of sports undertakings. With reference to sports injury risk of the project, it attaches importance to the choice of the parties, and examines the subjective vicious person. |
