| 摘 要： | 在全球经济飞速发展的今天，环境公益诉讼已经成为各国对环境权利进行救济的重要措施之一。从环境公益诉讼的诉讼资格研究入手，通过对诉讼资格的重新定位，探寻在现今社会环境不断发展的状况下，如何加大对环境权的保护，并对诉讼资格的主体范围进一步阐释，进而分析环境公益诉讼诉讼资格对我国环境刑法法益产生的影响。比较国内外环境刑法法益现状，在扩大诉讼资格的同时有必要明确我国环境刑法法益存在的缺失，并提出如何扩充环境刑法的内涵。
