| 摘 要： | WTO争端解决机制继承了GATT有利于争端解决的制度与惯例,具有了一个坚实的起点。上诉机构作为WTO体制甚至是国际法领域的一项创新,在过去的九年中在树立成员方对争端解决机制的信心从而维护WTO多边贸易体制方面发挥了积极作用。本文探讨和总结了上诉机构缺陷与完善,以期为我国参与WTO争端解决实践提供理论上的参考。

| Abstract: | The WTO Dispute Settlement Mechanism bases on the core rules ef the GATT Dispute Settlement Mechanism. The appellate body, as an innovation in WTO regime even in the field of international law, has been playing an active role in the past nine years in building up WTO member confidence in WTO. This Article discusses and summarizes the weakness and perfection of the appellate Bodies legal interpretation with intent to provide theoretical grounds for Chinas participation of WTO dispute settlement practices. |
