生物技术条件下跨国种业公司的垄断策略及对策研究

摘    要:生物技术条件下,跨国种业公司在我国种业市场上采取了不同于其他产业的垄断策略,其垄断行为的表现形式可以分为专利垄断、种子标准垄断、种业技术联盟、种子技术锁定等几种。跨国种业公司的垄断行为不仅危害了国家粮食安全、控制了我国种子资源、损害了农民权益,而且还严重制约了我国种子企业的研发能力。针对这种情况,在改革我国种业体制,加强我国本土种子企业的研发能力的基础上,应当通过完善知识产权法律规范、反垄断法律规范和外商投资法律规范,利用外资发展种子产业,同时规制跨国种子公司在我国种子市场垄断、限制竞争等行为。

Abstract:Under the condition of biotechnology, international seed industry company has taken different monopoly strategies in our country, which can be divided into patent monopoly, seed standard monopoly, seed industry technology alliance, seed technology lock, etc. These strategies not only harm the security of national food, control the germplasm resources in our country and deduce the interests of the famers, but al- so seriously restrict the research and development ability of seed enterprises in our country. Facing such con- dition, our seed industry system should be reformed, the research and development ability of domestic seed enterprises should be strengthened. Then the intellectual property law, the anti-monopoly law and foreign in- vestment law should be perfected when using foreign capital to develop our seed industry, at the same time transnational seed companies monopoly in China's seed market should be regulated.
