| 摘 要： | 刑事诉讼中的多元利益由于诉讼主体的不同而有区别，并且可以把它分为二个利益位阶。这两个利益位阶的冲突主要表现在永久性利益冲突和暂时性利益冲突上，对此，应该采取相应的平衡保护措施。而审判机关作为一个中立者，它的利益除公正、公平、效率之外就没有其他的利益，因而它的中立性是刑事诉讼中的二个阶层利益能否得到有效平衡保护的前提。
