| 摘 要： | 行政自由裁量权作为行政权力的组成部分,是现代行政管理的一个重要特征,该权力的存在和扩张有其客观的基础。也应认识到弹性和灵活性很强的行政自由裁量权是一把双刃剑,在依法行政、建设法治政府的过程中要明确其与行政法治的关系,建立起一套健全的机制规范、监督和控制自由裁量权,保障其良性运作。

| Abstract: | As an important feature of modern administration, the administrative discretion has become an active part of administrative right. Its existence and expansion is on the basis of objective necessity, meanwhile we should realize that it has both positive and negative functions. In the course of realizing the rule of administrative law, we should make clearer orientation of administrative discretion, then set up an efficient system to supervise and control its practice, thus secure its smooth implementation. |
