| 摘 要： | 劳动刑法的机能是指在现实生活中劳动刑法规制侵犯劳动者权益犯罪行为时所能发挥的良性动态作用。在以调整集体劳动关系为主的现代劳动法治社会，我们引入法的价值位阶作为参判标准将劳动刑法的机能划分为自由保障机能、正义矫正机能、规范维护机能这三大类。同时，还有赖于不苛求劳动刑法承担过度社会防卫理念的确立，劳动刑法机能的现实运行才能真正实现对劳动者权益确定的、及时的、持续的保护。 |

| Abstract: | The function of Labor Criminal Law refers to the benign dynamic role in real life when the reg-ularities of Labor Criminal Law violate laborers’ rights and interests. In modern society under the rule of Labor Law, the value and rank of introducing method as reference standard divide the function of Labor Criminal Law into safeguard function of freedom, justice correction function and standard maintenance func-tion. At the same time, they depend on undemanding labor criminal law to establish the concept of exces-sive social defense so that the actual operation of Labor Criminal Law can really achieve the definite timely and continuous protection for the laborers’ rights and interests. |
