| 摘 要： | <鸳鸯被>的故事从表面看只是婚姻纠葛这样的民事纠纷,但该纠纷却从头至尾都与刑事案件纠缠在一起.本故事包含有一起真正的刑事案件--张瑞卿骗奸(强奸)案.这起骗奸案在承袭冒名顶替骗奸情节的同时,却完全改写了此类故事的内涵:冒名顶替骗奸者张瑞卿获得了婚姻和伦理的支持,被冒名的刘员外却受到了惩罚.张瑞卿骗奸的表面逻辑是为了保证女性的性只能被一个男人所拥有,但更深层次的骗奸逻辑在于作者时其骗奸行为的内涵作了颠倒黑白的道德评定.这种创作逻辑的实质是元杂剧中随处可见的文人特权意识.
