| 摘 要： | 精神损害赔偿是民法的重要制度之一.对于著作侵权是否可以适用精神损害赔偿,近现代大陆法系国家在立法上持肯定的态度,而我国立法尚属空白.为此,法学界应该探讨著作侵权适用精神损害赔偿的理论基础和归责原则、适用范围、赔偿标准等问题,以期完善我国立法.
