摘    要:我国行政诉讼中法人或者其他组织终止后的原告资格转移制度存在诸多漏洞,法律规定过于宽泛,尤其承继原告的范围过于狭小,不应仅限于承受其权利的法人或其他组织。当法人或其他组织发生合并、分立时,由承受其权利的主体作承继原告;因其他原因终止的,由其清算组或管理人作承继原告;特殊情况下,由其撤销机关、主管部门、开办单位、股东作承继原告。

Abstract:There are quite some problems and insufficiencies in the present laws about the plaintiff qualification transfer after the corporate or organizational end in litigation.The rules are too general and the scope for succession of the plaintiff qualification is especially restricted.However,this must not be confined just to the corporation or the organization that bear the rights.In case of corporate combination or separation,it is up to the subject bodies that enjoy the rights,while in other cases it is up to the liquidating group or the administrator to succeed the plaintiff.In some special cases,it is up to the dismissing institution,administrative department,running corporation or shareholders to succeed the role of plaintiff.
