| 摘 要： | 是否承认并采用物权行为理论 ,是物权立法及整个民事立法必须解决的基本的技术问题。但由于该理论的高度抽象性及其深奥的内涵使其具有脱离生活之嫌 ,因此本文旨在通过厘定物权行为概念及剖析物权行为理论内容 ,以证明对该理论持肯定态度的合理性。

| Abstract: | Whether to acknowledge and adopt the property act theory is a fundamental technical problem to solve in property act legislation and civil legislation., but its great abstract and rich connotation account for the suspicion of it being not practical. The paper tries to demonstrate a positive attitude toward the property act by defining and analyzing the theory. |
