论Trips协议对我国商标法的影响

摘    要:我国正式加入世界贸易组织后 ,经济法律法规与WTO规则的衔接与清理工作陆续展开。作为WTO文件的一个重要组成部分 ,《与贸易有关的知识产权协议》(Trips)也将逐渐被国人接受。我国现行的《商标法》与Trips协议等有关国际公约相比 ,仍存在着诸如商标权主客体范围、商标权产生条件及灭失原因等方面的相当差距。对待以上问题 ,应在驰名商标保护、商标的反向假冒及商标的权利限制等方面进行改进工作

Abstract:China Entered WTO in due from on November, 2001.The job that China's economic rule of law links up with WTO rules will be evolved. As an important constitution of WTO document, "Trips" will be accepted by China. But "Law of Brand of China has much difference to "Trips". As those problems, it will bring forward some promotion on how to protect resound brand and how to prevent counterfeiting brand, etc.
