| 摘 要： | 本文认为，学术界有关滥用职权的范围和性质的主流观点缺乏充分的论据支持，是不能成立的。根据理论和实践两方面的考察分析，文章指出；滥用职权的范围不限于自由裁量权，任何一种行政职权都可以成为滥用的对象；滥用自由裁量权不属于违法行政而是不当行政。

| Abstract: | The paper thinks that the ruling point of view on the scope and quality of abusing administrative power is untenable, being short of sufficient grounds to support it. The Author point out that the scope of abusing administrative power is not limited to discretionary power, and any kinds of administrative power has a possibility of being abused; Abusing discretionary power is not an unlawful administrative act but an improper administrative act. |
