| 摘 要： | 诚实信用原则兼有道德性规范和法律性规范的双重特点。诚实信用原则在大陆法系内的确立，是对大陆法系追求法律的绝对主义，否认司法活动的能动性造成的弊端的补救。就其宗旨而言，任何大陆法系国家法律中规定诚实信用原则或有关诚实信用的具体法律规范，目的都是为了维护某种秩序，以体现一定的利益平衡。诚实信用原则具有补充性、不确定性、衡平性的特点，并产生确定行为规则、平衡利益冲突、为法律和合同的解释确定准则、减少交易费用从而增进效率四项基本功能。

| Abstract: | The principle of good faith has dual features,which could be both moral criterion and legal criterion.The establishment of good faith in mainland legal system made up for the abuse in the system caused by seeking the absoluteness of law and ignoring the motivation of legal activities.The principle and regulation of faithfulness and credit aim to maintain a kind of order,which represents the balance of benefits.The good faith has three characters: complementarily,uncertainty and equation.And it also has four major functions: defining the regulation of behaviors,balancing the confliction of benefits,setting the rules for explaining legal contract,and improving efficiency by means of reducing exchange fee. |
