| 摘 要： | 雇员人身损害赔偿责任包括三个构成要件:存在雇佣关系,雇员从事雇佣活动和雇员遭受人身损害。我国关于雇员人身损害赔偿责任的规定存在不真正连带责任运用中的问题和责任承担失衡问题,基于上述两个问题,本文提出完善的对策。
