| 摘 要： | 常设国际刑事法院的建立牵涉到许多国际法律问题，其中，如何处理国际刑事法院管辖权与联合国安全理事会职权的关系，是学者们和各国政府争议最大的问题之一。若在国际刑事法院的运作中赋予联合国安理会过大的权力，将会使国际刑事法院受到安理会政治影响的制约，并将损害法院的司法独立性和公正性；若完全撇开安理会，又不符合国际社会的现实。尽管《国际刑事法院规约》确定的管辖权在一定程度上限制了联合国安理会职权，但是安理会仍然对国际刑事法院具有重大的影响。

| Abstract: | The establishment of the standing International Criminal Court involves many issues of international law, among which the relationship between the International Criminal Court's jurisdiction and the Security Council's authority has become one of the most controversial issues among scholars and different nations. If the International Criminal Court endows the Security Council with excessive authority in its operation, it will be constrained by the political influences of the Security Council and its independence and impartiality will be undermined. On the other hand, it will not be feasible for the International Criminal Court to put the Security Council aside in the international community. Although the jurisdiction stipulated in statute of the ICC restricts the Security Council's authority, the Security Council still exerts no insignificant impact on the International Criminal Court. |
