| 摘 要： | 管辖权的确定是争端解决的前提，WTO争端解决机构审理案件同样如此。分析启动WTO争端解决程序的条件和DSB管辖权的特点，可知DSB管辖权是有限的，D6B不能受理指控违反人权法的申诉，也无权解释、评估某项贸易措施是否符合人权法，但这并不妨碍它以符合人权法的方式就争议问题作出裁决。
