| 摘 要： | 债权不可侵性理论源于实践。有关债权不可侵性是否存在的争论曾在理论及司法界存在很长时间。通过对债权的相对性分析，我们发现债权不可侵性与债权相对性并不矛盾。债权具有不可侵性是债权的固有属性，不是相对性原则的突破，也不是债的效力扩张的结果。
