| 摘 要： | 新专利法将于2009年10月1日起施行，修订后的条款增加了新的不侵权抗辩方式，即现有技术抗辩。与现行的公知技术抗辩方式相比，现有技术抗辩具有较高的抗辩成功率和较低的抗辩成本，必将成为使用频率较高的不侵权抗辩方式。“万艾可”案经历了侵权起诉、不侵权抗辩（宣告专利权无效）和司法裁决等过程，最终以辉瑞公司胜利而告终。新的抗辩方式“现有技术抗辩”给国内“万艾可”生产企业带来了一线希望，如何来保护自己合法权益，相关企业还有很长的路要走。

| Abstract: | New patent law will come into force on Oct 1, 2009. Existing technology defense is added in the revised law. Compared with current no-infringement defenses, existing technology defense has higher success rate and lower cost, and it will become the no- infringement defense mode with higher application frequency. The case of Viagra has experienced the process of infringement, no- infringement defense （declaration of patent right ineffective） and judicial decision, and finally Pfizer Inc. obtained victory. New defense mode brings a flash of hope to domestic companies manufacturing and distributing Vigara. But how to protect domestic companies＇ legal rights by this new defense mode is what domestic companies should think of more. |
