| 摘 要： | 合法性是所有政治体系都必须面对的一个问题。《政府论》提出“基于被统治者同意”的政治合法性概念;《大学》则从道德人格的塑造出发,构建政治统治的合法性。由中西文化传统中关于合法性建构的不同路向主张,引发出“人治”和“法治”两种不同的治国方略。

| Abstract: | Legitimacy" is an important issue which any political system must deal with. John Locke argues that the legitimacy of government is based on the consent of the governed, while the traditional Confucianism claims that it can be derived from moral cultivation. Their different interpretations of legitimacy resulted in contrary administration concepts: "the rule of law" and "the rule by man". |
