| 摘 要： | 当人肉搜索突破道德涉及法律，人肉搜索行为就演变为网络侵权法律问题：侵犯隐私权和名誉权的直接法律问题；法律制裁与道德谴责的区别、人肉搜索的后续侵权行为、提供搜索论坛网站的法律责任间接法律问题。但人肉搜索侵权行为并不是抽象和不可捉摸的，只是披着网络外衣，与一般的侵权行为没有本质的区别。

| Abstract: | When the human flesh search breakthrough morals involving the law,the human flesh search behavior evolves for the legal matter of network right infringement: the direct legal matter Including the right of privacy and the right of reputation;the indirect legal matter Including three aspects: the difference of legal sanction and morals condemned,the human flesh search's following abuse of authority,the legal liability of providing the search forum website's Website company.In view of these the serious legal matter,this article has carried on the discussion,obtains the human flesh search is not abstract and evasive,just throwing over the network coat,it's not the essential difference of the human flesh search and the general abuse of authority,the Conclusion have certain significance to solves the problem. |
