| 摘 要： | 刑事公诉案件庭前程序是人民法院审判程序的准备阶段，包括公诉审查程序、庭前准备程序两个方面。作为整理和明确讼争要点、提前处理和分流部分案件等诸多功能的程序，应当建立单独的庭前审查庭，改程序审查为程序和实体审查并重，规范法院的行为，以确保当事人诉讼权利得到充分保障，实现司法公正。

| Abstract: | The criminal pretrial procedure is the preparation phase of the trial process of the people＇s court, including the procedure of public prosecution review and pretrial preparation. As the process of ar- ranging and defining the dispute, pretreating and shunting part case, the court should establish a separate pre-trial review tribunal. Reviewing procedure should be changed to laying stress on both procedure and reviewing fact. The court action should be standardized to safeguard the client＇s litigation rights and judicial justice. |
