| 摘 要： | 监听的技术性与秘密性决定了它在真实发现上的独到优势。但是,一旦运用不当,监听极易侵犯他人隐私权。在职务犯罪侦查中构建符合我国国情的监听制度,应当平衡真实发现与隐私保护之间的关系,结合我国职务犯罪侦查体系的特殊性,完善监听适用范围、适用程序以及非法监听的权利救济。
