| 摘 要： | 数据库权利作为一种特殊权利保护是目前比较流行的观点，并且已经在欧盟境内变成了一种法律现实。这种观点认为，版权法、合同法、反不正当竞争法、技术措施等不能提供足够的经济激励，因此必须在现有法律保护模式之外创设一种新的保护模式，以保护数据库制作者对其享有的权益，这就是特殊权利保护模式。从价值目标的角度看，数据库特殊权利保护的合理性在于兼顾了公平和效率的双重价值目标。从法律经济学角度看，数据库权利作为特殊权利保护对数据库制作者和社会都是有益的。

| Abstract: | Database right as the protection of special rights is a popular view, and has become a legal reality in the European Union. In this view, because copyright law, contract law, unfair competition law and technical measures can not provide sufficient economic incentives, it is necessary in the existing mode of legal protection to create a new protected mode in order to protect the rights and interests of database producers, and this is the special rights protection mode. From the point of view of the value of the target, protection of the special rights of the database lies in the fact of a reasonable balance between equity and efficiency of the double value objectives. From the point of view of legal Economics, the database as a special right is beneficial to the protection of the rights of database producers and society. |
