| 摘 要： | 《中华人民共和国侵权责任法》将强化学校等教育机构的安全教育和管理职责提升到法律层面,有利于教育教学活动以及安全管理活动的开展,但与教育和教育制度存在一定脱节,现有规定在实践中可能形成认识上的不统一和适用性的难题。应依照教育法律关系的不同分别规定不同教育阶段学校等教育机构承担侵权责任的归责原则,按照侵权主体的不同,分别规定学生、教师及其他工作人员、学校等教育机构致人损害情况下的侵权责任,明确规定学校等教育机构侵权条款与特别条款的效力关系,并增加必要的与学校教育密切相关的免责条款。
