| 摘 要： | 宪政与民主分别同消极自由理念与积极自由理念相对应,也就必然反映两种自由理念的对立统一关系。积极自由和消极自由分别回答了“谁治理我?”和“我被治理的程度如何?”这两个问题,但它们要求自我实现和自我发展的出发点是一致的。民主主张积极参与和行使国家权力,宪政则强调以保障个人基本权利和自由为目的限制政治权力,两的互补互动、磨合产生了宪政民主制,较为有效地解决了人类政治生活中重大的两难问题。

| Abstract: | Constitutionalism is correlative to the ideology of negative freedom and democracy is correlative to the ideology of positive freedom. So they certainly reflect the opposite and unitive relationship of the two freedom. The ideology of positive freedom answers this question: "By whom am I governed ?"and the ideology of negative freedom answers this one: "How much am I governed?"But they have the same starting point in the demands for self-realization and self-development. Democracy claims that people should share and exert the national power. Yet constitutionalism emphasizes that the political power should be limited by basic individual rights and freedom. These two theories are reciprocate. Thus results the constitutionalism-democratic system. It settles the important and difficult dilemma in political life of the human beings. |
