| 摘 要： | 听证制度作为行政参与，民主和监督制度中最重要的制度之一，是我国行政法律制度中最年轻而又充满尖力的制度，是行政程序现代化和民主化的重要标志，笔者通过剖析我国地政立法的特点及现状，结合英美一些国家的实践及听证制度在行政管理中的作用，说明在我国行政立法中引入听证制度的必要，并对听证制度实施的条件和具体设计做了进一步探讨。

| Abstract: | The system of hearings is one of the most important systems of the systems of administrative participation, democracy and democratic supervision .It is the youngest and the most dynamic system in China's administrative legislation,and an important sign of the modernization and democratization of China's administrative procedure. Based on the analysis of the characteristics and the status quo of China's administrative law, and taking into account of the practice and the function of the hearings system in administration in western countries, this paper points out the necessity of the hearings system being included in the administrative legislation and makes further explorations of the details of the system and the conditions under which the hearings system is to be put into practice. |
