| 摘 要： | 定罪司法解释的功能在于将定罪的过程具体化,引导法官将具体行为定格在刑法条文所设立的模型之中。罪刑法定是我国刑法的基本原则,定罪司法解释需要在罪之法定原则的制约下,以客观存在着的刑法条文为对象进行解释。作为连接刑法条文和司法定罪的桥梁,定罪司法解释的内容只能是原罪犯罪构成要件的明确化,对模糊性犯罪构成的解释需要解释者通过分析其他明确要件的方法来使模糊要件清晰化,原罪具体的构成要件作为定罪司法解释具体的标准不可突破。

| Abstract: | The function of the judicial interpretation about conviction is to specify the process of the conviction.It also leads the judge to putting the act into the model established in the Criminal Law.The principle of a legally prescribed punishment for a specified crime is the basic principle of the Criminal Law.The judicial interpretation about conviction can only interpret the articles of the Criminal Law.It is the explication to the constitution of crime.The interpretor should explicate the ambiguous element by analyzing the other explicit elements.The judicial interpretation about conviction can not violate the particular standard constituted by the elements of the crime. |
