摘    要:实施聘任制是我国教师人事制度改革的一种必然趋势。要使该制度得到公平、公正的实施,应研究的问题有很多,其中较为核心的问题有两个:一是要建立和完善教师聘任方面的法律法规;二是要加强对校长权力的制约。要建立和完善教师聘任方面的法律法规,应研究聘任主体,聘任和解聘教师的法定程序,教师被解聘后的维权途径等三个法律问题;要加强对校长权力的制约,应提升教代会、教育工会、教师协会的权力,使教职工寻求到与校长权力相均势的利益支撑者。

Abstract:It is an inevitable trend of implementation of teacher appointment system in reformation of personnel system. In order to make the reformation fair, there are a lot of aspects to be studied, especially how to establish and improve laws and regulations on teacher appointment system and how to restrict power of principals. Appointment mainbodies, statutory procedures of teacher appointment and firing and ways to safeguard rights after being fired are three legal problems that must be studied to establish and improve laws and regulations on teacher appointment system; In order to restrict power of principals and make a balance between the power of staff and principals, it is necessary to increase the power of staff congress, union of education and teachers association.
