| 摘 要： | 表达自由是公民的基本权利,它与思想自由和行为自由有显著不同。美国公立中小学校教师享有职务表达自由与个人表达自由。教师个人表达又分为教师公言论与教师私言论。教师职务表达受学校教育的使命与学生的未成年人特点的影响而受到严格限制。教师的公言论比私言论受到更大程度的保护,但教师个人表达一旦与学生利益发生冲突,无论是教师公言论、还是私言论,都要受到适当限制。
