| 摘 要： | 法律是保护非物质文化遗产的重要手段,法律保护模式是实施这一手段的重要内容,对于有序开展非物质文化遗产法律保护工作具有重要意义。本文从非物质文化遗产的法律界定和性质特征入手,在分析非物质文化遗产法律保护模式主要理论观点的基础上,提出我国应确立以行政法为主的公法保护模式为经线,以知识产权法为主的私法保护模式为纬线,国内法与国际法相结合的立体、互补、综合保护的非物质文化遗产法律保护模式基本框架。

| Abstract: | Law is an important means to protect the intangible cultural heritage.Legal protection mode is considered as the significant content to perform this means,because it has great significance for orderly developing the legal protection of intangible cultural heritage.This paper started from the discussions on the juristic definition and characteristics of intangible cultural heritage,then analyzed the major relevant theories on the models of legal protection for the intangible cultural heritage,and further stated the author’s opinion that our country should set public laws,dominantly the administrative laws as the basic model of legal protection,aided by the private laws,fundamentally the intellectual property rights law,and then establish a solid,complementary and integrated model of legal protection for the intangible cultural heritage combined with domestic laws and international laws. |
