| 摘 要： | 环境污染损害作为现代特殊侵权之一,具有不平等性、价值性、不明确性和缓慢性特征.环境污染损害赔偿中实行无过错责任原则,免责条件有不可抗力,受害人自身责任和第三者过失三种.民事诉讼中举证责任问题倒置,这对于解决环境民事纠纷具有重要的实践意义.
